BNSS Section 183 — Recording of confessions and statements
Drafting note. The newly added first proviso to Section 183(6)(a) provides that statements are to be recorded by a woman Magistrate as far as practicable.A newly added second proviso to Section 183(6)(a) provides for mandatory recording of a statement of witness by Magistrate relating to the offences punishable with imprisonment for ten years or more, imprisonment for life, or with death.The fourth proviso to Section 183(6)(a) provides for the recording of the statement of a temporarily or permanently mentally or physically disabled person through audio-video electronic means.
